Welcome to www.flexestate.nl (“the Platform”). These Terms and Conditions Flex Estate apply to all users of our platform. Therefore by accessing or using Flex Estate, you agree to the following terms and conditions. If you do not agree, please do not use the Platform.

1. About Flex Estate – Terms and Conditions Flex Estate

Flex Estate is an online platform that facilitates real estate transactions between private individuals. We are not a licensed real estate agent or intermediary. We provide digital tools and services that help users list, promote, and manage their property sale or rental.

2. User Responsibilities – Terms and Conditions Flex Estate

  • You are solely responsible for the accuracy and legality of the content you post.
  • You confirm you have the legal right to sell or rent the property you list.
  • Misuse of the platform for fraudulent, misleading, or illegal activities is not allowed. Any breach may result in account suspension.
  • You may not impersonate another person or business.

3. Listing & Publication

  • All listings must be submitted for approval and are subject to manual review.
  • We reserve the right to reject or remove any listing that violates laws, platform policies, or public decency.
  • Submitting a listing does not guarantee publication or visibility.

4. Paid Packages and Add-Ons under Terms and Conditions Flex Estate

  • All package purchases are one-time, upfront payments, and non-refundable once services are delivered or activated.
  • Prices exclude VAT (21%) unless stated otherwise.
  • Any delay in service delivery caused by you (e.g. missing documents) does not entitle you to a refund because you have to make sure you get everything ready before listing your property.

5. Third-Party Services

  • Some services (e.g. valuations, photography, energy labels) are performed by independent third parties.
  • Flex Estate is not responsible for any errors, damages, delays, or disputes arising from third-party services.
  • Any agreement or communication with these service providers is at your own risk.

6. No Guarantee of Results

  • Flex Estate does not guarantee that your property will be sold, rented, or viewed.
  • You remain responsible for communicating with potential buyers or tenants and handling negotiations and contracts. These Terms and Conditions Flex Estate apply to all users of our platform.

7. Limitation of Liability – Flex Estate Terms and Conditions

Flex Estate is not liable for:

  • Missed offers or failed transactions
  • Loss of data or content
  • Misuse of your listing by third parties
  • Any financial, personal, or legal damages arising from use of the platform

Our total liability is limited to the amount you paid for services on the platform.

8. Platform Access & Availability

  • We do our best to keep the platform online, but we do not guarantee uninterrupted availability.
  • We may perform maintenance, updates, or changes that affect functionality.

9. Termination & Suspension

  • We may suspend or terminate your account if:
    • You violate these terms or any laws
    • You misuse the platform or provide false information
    • We detect suspicious or harmful activity
    • In addition, you must not give any inaccurate property details
  • As a result in such cases, no refunds will be issued.

10. Privacy & Data Use

  • All data is processed according to our Privacy Policy.
  • You have the right to request access or deletion of your personal data at any time.

11. Changes to Terms

We may update these Terms & Conditions at any time. Changes take effect immediately upon publication. It is your responsibility to stay informed.

12. Governing Law

These terms are governed by Dutch law. Any disputes will be handled by the courts in Rotterdam, the Netherlands.
