FLEX ESTATE – DISCLAIMER

Flex Estate (“Flex Estate”, “we”, “us” or “the Platform”) operates an online real estate platform through which property owners, landlords, buyers and tenants can advertise properties, communicate and use tools and services relating to the sale or rental of real estate.

Flex Estate offers different service levels, ranging from self-service platform functionality to additional sales, rental and property-related support. The services and responsibilities applicable to a user depend on the specific product, package or additional service purchased.

This Disclaimer should be read together with our Terms & Conditions, Privacy Policy and, where applicable, our Bidding Policy.

1. No Legal, Tax, Mortgage or Investment Advice

Unless a service is expressly described otherwise, information made available through Flex Estate, including general property information, calculators, automated valuation indications, templates and platform-generated information, is provided for general informational purposes.

Flex Estate does not provide legal, tax, mortgage or investment advice.

Where professional advice is required, users should obtain advice from an appropriately qualified professional.

Flex Estate may facilitate access to independent professionals and service providers. Any professional advice provided by such a third party remains the responsibility of that provider.

2. Property Information and Listing Content

Property information may be provided directly by property owners or landlords and, depending on the selected service, may also be prepared, edited or processed by Flex Estate using information and documentation supplied by the customer or obtained from relevant sources.

Property owners and landlords remain responsible for providing complete and truthful information about their property and for informing Flex Estate of facts or circumstances that may be relevant to prospective buyers or tenants.

Flex Estate takes reasonable care when processing information as part of a purchased service but cannot guarantee that information supplied by users or third-party sources is always complete, current or error-free.

Flex Estate may correct, reject, suspend or remove content where reasonably necessary, including where information appears inaccurate, unlawful, misleading or contrary to our policies.

3. No Guarantee of Sale or Rental

Flex Estate does not guarantee that a property will be sold or rented, that a transaction will be completed within a particular period, or that a particular sale price, rental price or level of interest will be achieved.

Results depend on circumstances outside Flex Estate’s control, including market conditions, asking price, property characteristics, presentation, demand, financing and decisions made by buyers, sellers, landlords and tenants.

Any valuation, price indication or automated estimate is not a guarantee of the eventual transaction price unless expressly provided as a formal valuation by a qualified third-party valuer.

4. Viewings, Scheduling and Property Access

Flex Estate may provide technology and/or services for arranging and managing property viewings.

Property owners remain responsible for ensuring that their property can be accessed safely unless expressly agreed otherwise as part of a purchased service.

Flex Estate cannot guarantee that prospective buyers or tenants will attend scheduled appointments and is not responsible for the independent conduct of visitors.

Nothing in this section excludes liability that cannot legally be excluded under applicable Dutch law.

5. Third-Party Services and Partners

Certain Flex Estate packages or additional services may involve independent third-party providers, including photographers, measurement specialists, energy-label professionals, valuers, mortgage advisers, notaries, publication partners and other property-service providers.

Depending on the service purchased, Flex Estate may arrange or coordinate such services on the customer’s behalf.

Where a third party performs the professional service, that provider remains responsible for the proper performance of its own professional activities, subject to the applicable agreement and mandatory law.

The applicable product or package description will indicate which services are included and which services must be purchased separately.

6. Third-Party Property Portals

Flex Estate may facilitate or arrange publication of properties on external property portals, including Funda, either directly where available or through an authorised publication or technology partner.

Publication on an external platform remains subject to that platform’s acceptance criteria, technical requirements, presentation options, availability and terms.

Flex Estate cannot guarantee uninterrupted publication, a particular search position, number of views, enquiries or other results generated by an external property portal.

7. Platform Availability and Technology

Flex Estate takes reasonable measures to maintain the availability and security of its Platform. Nevertheless, temporary interruptions may occur because of maintenance, hosting, software, external integrations, internet connectivity or circumstances outside our reasonable control.

Flex Estate does not guarantee that every platform function will be continuously available or entirely free from technical errors.

Functions may be modified, replaced or discontinued where reasonably necessary.

8. Offers, Bids and Negotiations

Flex Estate provides tools through which prospective buyers may submit offers and property owners may receive and review them.

The legal effect of an offer, acceptance or agreement depends on the circumstances and applicable Dutch law. Users should therefore not assume that every action performed through the Platform automatically creates a legally binding purchase agreement.

Where negotiation or sales support forms part of a purchased Flex Estate service, Flex Estate may assist the customer during the negotiation process. The property owner retains the final decision whether to accept, reject or negotiate an offer unless expressly agreed otherwise.

Flex Estate does not guarantee the financial capacity of a prospective buyer solely because an offer has been submitted through the Platform.

Where buyer verification or financial-preparation information is displayed, the meaning and scope of that verification will be stated separately and should not be interpreted as a guarantee that financing will ultimately be obtained.

9. Package Scope and Additional Services

The services included in a Flex Estate package are limited to the services expressly stated in the applicable package description or order confirmation.

Services that are not included, including additional revisions, additional marketing or property materials, additional professional services or other work outside the purchased package, may be offered separately for an additional fee.

10. Limitation of Liability

Flex Estate is responsible for the services it expressly undertakes to provide, subject to the applicable agreement and mandatory Dutch law.

To the extent permitted by law, Flex Estate is not liable for losses resulting from inaccurate or incomplete information supplied by users or independent third parties, decisions made independently by users, acts or omissions of independent service providers, or circumstances outside Flex Estate’s reasonable control.

Any limitations or exclusions of liability are subject to applicable mandatory consumer law and do not apply where liability cannot legally be excluded or limited.

11. User Responsibilities

Users are responsible for providing accurate and complete information, complying with obligations applicable to them as property owners, landlords, buyers or tenants, reviewing relevant property and transaction information, and making their own final decisions.

The level of support provided by Flex Estate depends on the package or service selected. Purchasing a self-service product does not include services that are only included in an assisted or Full Service package.
