📄 FLEX ESTATE BIDDING POLICY
Last updated: [13/09/2026]
1. Purpose of this Bidding Policy
This Bidding Policy explains how bidding works on the Flex Estate platform and what rights and obligations apply to buyers and sellers when a bid is placed. By placing a bid you agree to this policy and to the general Terms & Conditions of Flex Estate.
Flex Estate provides a platform for property sales and may, depending on the service selected by the seller, also provide sales guidance and mediation. In Self-Service, the seller manages the sale independently using the platform and any additional services selected. Under Full Service, Flex Estate may actively guide and mediate the sale in accordance with the agreed sales assignment. Flex Estate is not a party to the purchase agreement between buyer and seller.
⸻
2. Definitions
• Platform: the Flex Estate website and all related services.
• User: any person using the platform (buyer, seller or interested party).
• Seller: the person or party offering a property for sale through the platform.
• Buyer: the user who places a bid on a property via the platform.

⸻
3. Registration and Verification
3.1. To place a bid, the buyer must create a personal account on Flex Estate and be logged in.
3.2. Flex Estate may require account verification before a bid can be placed. The applicable verification method is shown during the verification process and may include a €1 verification payment or another verification method made available by Flex Estate.
3.3. Verification is intended to reduce fake accounts and misuse of the platform. Verification does not guarantee a user’s identity in all circumstances and does not constitute a guarantee of the user’s financial position, reliability, intentions or ability to complete a transaction.
⸻
4. Placing a Bid
4.1. Bids are placed via the secure bid form on the property detail page.
4.2. Depending on the bidding process and property, the buyer may be asked to provide information including:
• bid amount
• financing status and/or financing conditions
• conditions attached to the offer
• requested completion or transfer date
• other information or documents relevant to the offer
• confirmation that the information provided is correct and complete.
4.3. By submitting a bid, the buyer confirms that:
the bid is made seriously and in good faith
the information provided with the bid is, to the best of the buyer’s knowledge, correct and complete
the buyer has read and accepted this Bidding Policy and the Flex Estate Terms & Conditions
⸻
5. Legal Status and Seller’s Decision
5.1. A bid submitted through the platform constitutes an offer by the buyer to the seller. The legal consequences of an offer, including whether and until when it may be withdrawn, depend on applicable Dutch law and the terms and conditions attached to that offer.
5.2. The seller remains free to accept or reject an offer, make a counter-offer, continue negotiations or choose another offer. The seller is not required to accept the highest offer. Price, conditions, financing, transfer date and other relevant factors may all be taken into account.
5.3. Acceptance of a bid through the platform does not by itself mean that a legally valid purchase agreement has been concluded. Where Dutch law requires a written purchase agreement, including in the case of a residential property purchased by a private consumer buyer, the purchase must be recorded in writing in accordance with the applicable legal requirements.
5.4. Flex Estate is not a party to the purchase agreement. Depending on the service selected by the seller, negotiations may take place directly between buyer and seller or Flex Estate may provide sales guidance and mediation on behalf of the seller in accordance with the applicable sales assignment.
⸻
6. Live Bidding and Private Offers
6.1. Where transparent live bidding is enabled for a property, the current highest live bid and certain non-personal bid information, such as the date and time of the bid, may be displayed on the property page. Personal information identifying the bidder is not publicly displayed.
6.2. A new live bid must meet the bidding requirements applied by the platform at the time the bid is submitted. If a live bid does not meet those requirements, the system may refuse the bid and ask the buyer to submit a different amount.
6.3. Where the private-offer function is available, a buyer may submit an offer privately. A private offer is not displayed to other bidders as part of the transparent live bidding process.
6.4. The highest live bid does not automatically win and does not oblige the seller to accept that offer. The seller remains free to consider the amount offered, conditions and other relevant circumstances when deciding whether and which offer to accept.
6.5. If another buyer places a higher valid live bid, Flex Estate may automatically notify the previous highest bidder and provide a link back to the property page. Such a notification is informational only and does not require or encourage the bidder to submit a new or higher offer.
⸻
7. Communication and Confirmation
7.1. After a bid is placed:
The buyer may receive a confirmation containing a summary of the submitted bid.
The seller and, where applicable, Flex Estate may receive the information required to review and process the bid.
7.2. In Self-Service, further communication and negotiations may take place directly between buyer and seller. Where the seller has selected Full Service, Flex Estate may communicate with interested buyers, coordinate offers and negotiations and otherwise assist the seller in accordance with the agreed sales assignment.
⸻
8. Withdrawal and Expiry of Bids
8.1. Whether a bid can be withdrawn or revoked depends on the circumstances of the offer and applicable Dutch law. A buyer who wishes to withdraw a submitted bid should notify the seller or, where Flex Estate is handling the sales process, Flex Estate as soon as possible.
8.2. A bid may include or be subject to a response or validity deadline. After the applicable deadline has passed, the offer may expire in accordance with its terms and applicable law.
8.3. In Self-Service, buyers and sellers are responsible for monitoring deadlines relating to their offers and communications. Under Verkoopbegeleiding, Flex Estate may assist with the coordination of deadlines as part of the agreed sales assignment.
⸻
9. Responsibilities of Buyers
The buyer is responsible for:
• providing truthful and complete information when placing a bid;
• ensuring that the proposed financing is realistic;
• arranging any inspections, valuations or legal advice;
• checking legal and technical information about the property, such as VvE documentation, leasehold, zoning and known property information.
Flex Estate does not provide legal, financial or tax advice.
⸻
10. Responsibilities of Sellers
The seller is responsible for:
• providing truthful, accurate and complete information about the property;
• clearly indicating which items stay behind (Lijst van Zaken) and any defects known to the seller;
• respecting agreements made with buyers and responding within a reasonable time;
• complying with applicable laws and regulations.
Flex Estate does not guarantee the accuracy or completeness of property information supplied by the seller or other third parties. Any review or assistance provided by Flex Estate does not relieve the seller of responsibility for the information supplied about the property.
⸻
11. Role and Limitation of Flex Estate
11.1. Flex Estate provides the platform and tools through which properties can be presented, buyers and sellers can communicate and offers can be submitted and registered. Depending on the service selected by the seller, Flex Estate may also provide sales guidance and mediation.

Under Verkoopbegeleiding, Flex Estate may actively assist with the sales process, including preparation, presentation, viewings, offers, negotiations and guidance towards the purchase agreement, in accordance with the agreed sales assignment. Certain specialist services may be carried out by independent professionals or partners.
11.3. Regardless of the service selected, the seller retains the final decision as to whether and which offer to accept. Flex Estate does not determine the winning buyer and is not a party to the purchase agreement between buyer and seller.
11.4. Flex Estate does not guarantee that:
- a property will be sold
- a particular offer will be accepted
- a buyer or seller will perform their obligations
- information, verification or a badge guarantees a user’s identity, financial position, reliability or ability to complete the transaction
11.5. Flex Estate may, at its own discretion:
remove or invalidate bids that are clearly abusive, fraudulent or submitted in violation of this policy
suspend or block accounts in cases of suspected fraud, abuse, spam or violation of this policy
correct obvious technical or display errors relating to bids
⸻
12. Logging, Evidence and Privacy
12.1. For security and evidentiary purposes, Flex Estate may log:
• IP address
• date and time of the bid
• user ID and property ID
• technical data about the browser/session
12.2. Personal data is processed in accordance with the Flex Estate Privacy Policy.
12.3. In the event of a dispute, Flex Estate may preserve relevant records and may disclose information where this is permitted or required by applicable law, including where necessary in connection with legal proceedings or a lawful request from a competent authority.
⸻
13. Abuse and Sanctions
13.1. It is prohibited to:
• place fake bids or bids without any serious intention to purchase;
• impersonate another person or use false identity documents;
• manipulate the bidding process (e.g. shill bidding, collusion);
• use offensive, discriminatory or threatening language.
13.2. Flex Estate may impose sanctions, including but not limited to:
• warning the user;
• removing or invalidating bids submitted in violation of this policy;
• temporarily suspending the account;
• permanently blocking the account;
• reporting serious cases to appropriate authorities.
⸻
14. Liability
14.1. Flex Estate is liable only to the extent provided for in the Flex Estate Terms & Conditions and applicable mandatory law.
14.2. Flex Estate does not guarantee that a bid will be accepted, that a transaction will be completed, or that information provided by buyers, sellers or other third parties is accurate or complete.
14.3. To the extent permitted by law, Flex Estate is not liable for losses resulting from acts or omissions of buyers, sellers or other third parties, or from decisions made by a seller regarding an offer.
14.4. Any exclusions and limitations of liability set out in the Flex Estate Terms & Conditions also apply to the use of the bidding functionality.
⸻
15. Applicable Law and Disputes
15.1. This Bidding Policy and all use of the Flex Estate platform are governed exclusively by Dutch law.
15.2. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law prescribes otherwise.
⸻
16. Changes to this Policy
Flex Estate may amend this Bidding Policy from time to time, for example due to changes in legislation, services or platform functionality. The most recent version will be published on the website. The version applicable at the time a bid is submitted applies to that bid, unless applicable law requires otherwise.
